Privacy Policy – Tzolkin App

This privacy policy is drafted in accordance with the GDPR (General Data Protection Regulation), the European legislation governing privacy and data protection. The GDPR defines how organizations may collect, process, and retain personal data, and what rights you have as a user.
This document explains how Groeidala (Sofie Laureyssens) handles personal data within the Tzolkin App. By using the app, you agree to this policy.

1. Who are we?

2. What data do we collect and why?
- Log and usage data: Service-related, diagnostic, usage, and performance data automatically collected when you use the app. This includes: IP address, device information, browser type, settings, in-app activity (such as timestamps, pages or files viewed, searches, clicked buttons), system activity, error reports (“crash dumps”), and hardware configuration.
- Device data: Information about the device you use to access the app, including device ID, type and model, OS version, mobile provider, browser info, system configuration, and unique identification numbers.
- Network data: Information about the network you’re connected to, such as internet service provider, mobile carrier, network name, and connection speed.
- Location data: Information about the (precise or imprecise) location of your device. This is only collected if you explicitly grant permission via your device or app settings (e.g., GPS). Without access, certain features may be less accurate or unavailable.
We do not process sensitive personal data. Sensitive data includes information about health, religion, sexual orientation, political beliefs, biometrics, or ethnicity. Such data is not requested, processed, or stored by the Tzolkin App.

3. Why do we process your data?
We process your personal data for various reasons depending on how you use the app. This includes:
- To calculate your Tzolkin profile, guide energy, and soul path
- To provide personalized partner cross and relationship analyses
- To create group analyses and connections from your contacts
- For technical functioning, troubleshooting, and app security
- For statistical analysis and user experience improvement
- To identify usage trends and gain insight into how the app is used
- To request feedback about your experience
- To process data when needed to protect someone’s vital interests (e.g., digital threats or harm)
- For optional communication about updates or content (only with your consent)
- To comply with legal obligations

4. What is the legal basis for processing?
The legal basis depends on where you reside:
If you are in the EEA, UK, or Switzerland, we process your data based on:
- Your consent (e.g., registration, contact import, newsletter)
- Contractual necessity (e.g., delivering app features)
- Legal obligations (e.g., tax, accounting)
- Our legitimate interest (e.g., improving service or preventing misuse), provided your rights and freedoms are not overridden
- Protection of vital interests (e.g., preventing harm or abuse)
If you are in Canada, we process your data:
- Based on your express or implied consent, depending on context
- Without consent in exceptional cases permitted by law, such as:
- When it is clearly in your interest and consent cannot be obtained in time
- For fraud detection or safety investigations
- In legal, insurance, or governmental contexts
- If there is suspicion of financial abuse
- For journalistic, artistic, or literary purposes
- If the data is publicly available per Canadian law

5. With whom do we share your data?
Your data is not sold and only shared:
- With service providers assisting in hosting, analytics, or payments (under GDPR-compliant agreements)
- When legally required (e.g., court orders or fraud investigations)
- In case of merger, sale, or acquisition, data may be transferred as part of business assets. You will be informed if applicable.

6. How long do we retain your data?
We retain your personal data only as long as necessary for the purposes described in this policy, unless a longer period is required or permitted by law (e.g., tax, accounting).
Once we no longer have a legitimate reason to process your data, we will delete or anonymize it. If immediate deletion is not possible (e.g., due to backups), the data will be securely stored and isolated until deletion is possible.

7. How do we protect your data?
We have implemented appropriate and reasonable technical and organizational security measures to protect your personal data against loss, misuse, unauthorized access, disclosure, alteration, or destruction. These include:
- Encryption of sensitive data

- Regular security updates and monitoring
Despite these measures, we cannot guarantee absolute security. No method of data transmission or storage is 100% secure. You use the app at your own risk and should access it in a secure environment (e.g., with device password protection or antivirus software).

8. What are your rights?
Depending on where you reside, you may have the following rights:

- Right to withdraw consent (if processing is based on consent)

9. Specific rights for California residents
Under California Civil Code Section 1798.83 (“Shine the Light” law), residents of California may request, once a year and free of charge, information about categories of personal data (if any) we shared with third parties for direct marketing purposes, and the names and addresses of those third parties. Submit such requests via info@groeidala.be.
Note: the Tzolkin App does not offer any feature to publish data publicly. The right to request deletion of public posts does not apply here.

10. Do Not Track features
Some browsers and mobile operating systems allow users to activate a “Do Not Track” setting. As there is currently no universally accepted standard, we do not respond to such signals at this time.

11. Changes to this policy
We may update this policy in response to legal changes, app updates, or changes in data processing. Major updates will be communicated via the app or by email.
